The admissibility and weight of evidence are determined by the tribunal, based on principles of fairness, relevance, and materiality. Arbitral proceedings, however, are not bound by the strict rules of the Code of Civil Procedure and the Evidence Act (now the Bharatiya Sakshya Adhiniyam), though the ‘principles’ of the same may apply. The objective of the webinar is to discuss what these principles would be and what procedure must be followed while taking evidence in arbitration proceedings.
